KIDZANIA WEBSITE CLARIFICATION TEXT

These principles (“Principles”) establish the collection, use and sharing of Personal Data by Akasya Çocuk Dünyası A.Ş.(Kidzania Turkey) in accordance with the Personal Data Protection Law No. 6698, through “https://istanbul.kidzania.com” and the applications published by KidZania affiliates (each “KidZania Company”) and third-party KZ Licensees (“KZ Licensees”) authorized by KidZania. When you use the website “https://istanbul.kidzania.com” and/or a KidZania application, you are deemed that you have agreed to the terms of these Principles.

TYPES OF INFORMATION COVERED BY THESE PRINCIPLES

These Principles apply only to Personal Data. “Personal Data” is information that can be used to contact or identify an individual. This includes the name and surname, full address, e-mail address, phone number, photo, or other identifying information of the persons, but the scope of Personal Data is not limited to the foregoing. Personal Data may also include non-identifying information that may be stored with Personal Data.

Non-identifying information, such as anonymous or aggregated data, is not covered by these Principles. We may collect, use and disclose such information for the purpose of communicating with our sponsors, advertisers, and KZ Licensees, evaluating and improving our service offerings.

LINKS TO OTHER WEBSITES

These Principles cover the website “https://istanbul.kidzania.com” and the applications published by KidZania. KidZania may also link to third-party websites that are not owned or controlled by a KidZania Company or Licensee. These third-party websites may collect the personal information of their visitors. The information practices of such third-party websites, organizations, or businesses, including those of our sponsors and commercial stakeholders, are subject to their respective privacy policies and are not within the scope or control of these Principles. KidZania does not guarantee and assumes no responsibility for the practices of these websites. Before leaving our website, we recommend that you check the privacy policies of each website you visit before providing your personal data.

DATA COLLECTION

In order for you to view our website, “https://istanbul.kidzania.com” does not require you to provide your Personal Data or to register. If you have questions or want to know more about KidZania, we will provide you with contact details so that you can contact us, and the personal data you provide to us accordingly is given on a voluntary basis. If you contact us by email or mail, we may use the Personal Data you provide to us to answer your questions, provide you with information about our services, fulfill your requests, improve our customer service, and for other internal purposes. In this case, we will not use your information for marketing purposes.

This information that you have shared with us for communication purposes will be destroyed after your request is met and in any case after the tax or commercial storage period expires.

KidZania may request a minimum of personal information regarding the use of a KidZania application on a mobile device. However, unless the application is used to download data to a KidZania website, online service, or a third-party service, that information is stored only on the mobile device and is not collected by KidZania. Due to concerns about minor users using applications to upload information that may contain personal date to the internet, KidZania seeks parental or guardian consent that the application may be used by them before allowing minors to upload to the KidZania website.

KidZania may use technical methods to collect certain non-personally identifiable information about visitors to the website. We may also work with a third-party service provider to collect similar information. To do this, KidZania companies and/or our service providers may use cookies or other technical methods to collect information and ensure its relevance over time. KidZania Companies, KidZania Licensees, and service providers do not combine anonymous data collected with Personal Data through the “https://istanbul.kidzania.com” website.

PURPOSES OF PERSONAL DATA COLLECTION

In order to achieve the above-mentioned purposes and to fulfill the obligations arising from the law, your personal data may be shared, to the extent necessary and limited to, with our suppliers, sponsors, business partners (software companies providing technical support services, etc.), with whom we cooperate and receive services, Social Security Institution, General Directorate of Security and other law enforcement agencies, General Directorate of Population, other relevant official institutions and organizations, courts, your authorized representatives, the institution you are affiliated with and/or work with, third parties we consult, including lawyers, tax consultants and auditors, regulatory and supervisory institutions and official authorities, domestic or foreign systems and/or companies established in Turkey and abroad within the body of Kidzania group companies and Akkök Holding group companies to which our Company is affiliated (for more detailed information, you can apply to our Company in writing).

RETENTION PERIOD

Your personal data mentioned above can be kept in both digital and physical environment by transferring it to the physical archives and information systems of our Company and/or our suppliers. Your Personal Data will be stored by us for as long as necessary for the above purposes or to comply with the legal retention period, and then destroyed in accordance with the Law.

LEGAL REASON

Your personal data is processed within the framework of the following legal reasons under Article 5/2 of the PDPL and shared with the above-mentioned persons and institutions:

When it is explicitly stipulated in the laws.
When it is compulsory for the protection of the life or physical integrity of the person or another person, who is unable to express their consent due to actual impossibility or whose consent is not legally valid.
When it is necessary to process the personal data of the parties to the contract, provided that it is directly related to the establishment or performance of a contract. When it is mandatory for the data controller to fulfill its legal obligation.
When it has been made public by the person concerned.
When data processing is mandatory for the establishment, exercise, or protection of any right.
When data processing is mandatory for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the data subject.

Login Information: To allow you to connect to the Site, our servers collect and record information about your computer and browser, such as your IP address, browser type, http reference data (where you visit KidZania), and other software and hardware information. If you access KidZania from a mobile or other commercial electronic device, we may collect the unique device identifier assigned to that device or other transactional information for that device.

Cookies and Other Tracking Technologies: We also use cookies and other tracking technologies (for example, browser cookies, pixels, and beacons), which are small bits of data that encapsulate an anonymous unique identifier. We use these technologies to understand how visitors interact with our site. Although most browsers are set to accept cookies, you can set your settings to block cookies. We do not use "permanent" cookies that remain after the user leaves the website. If KidZania works with third parties to provide, evaluate and improve online services, those third parties may use their own cookies or other technical methods to collect anonymous information about your use of the website. Information collected independently by third parties through our website is subject to that party's privacy policies.

USING AND SHARING PERSONAL DATA

KidZania may share Personal Data with KidZania Companies, KidZania Licensees, and service providers for the provision and administration of the website and our applications. For example, we may employ a third-party service provider or agent hosting the website to assist us with contests or promotions or to serve advertisements. Third-party service providers working on KidZania's behalf are required to agree to use Personal Data to provide services to KidZania Companies or an Operator only subject to these Principles.

The KidZania Companies, KidZania Licensees, and third-party service providers may use your Personal Data for the following purposes:

To answer your questions and provide customer support for your use of KidZania content and services available through our website or apps.
To transmit relevant event notices, content, and advertisements for products, services, contests, or promotions on behalf of KidZania, the KidZania Companies, KZ Licensees, or sponsors.
To measure and improve your experience on the website or with our apps.
In the event of bankruptcy or a merger, acquisition, joint venture or other business transaction relating to our website and our practices, Personal Data may be transferred as part of the company's assets, but remains subject to these Privacy Principles.

In addition, for the purposes of protecting the legal rights or property of KidZania, other KidZania Companies or their employees, agents, and contractors (including enforcing our contracts), protecting the safety and security of other KidZania users or the public, protecting the integrity of our website, protecting against fraud, or risk management, or Personal Data may be disclosed without prior notice if it is believed in good faith to be necessary to comply with the law or legal process.

KidZania may not sell, rent or share your Personal Data with third parties for any reason without your prior consent.

HOW DO WE PROTECT PERSONAL DATA?

Safety comes first for KidZania. We apply commercially reasonable principles and procedures to ensure an appropriate level of protection for the information we collect and store. Third parties to whom we disclose Personal Data subject to these Principles are also requested to implement similar practices to protect Personal Data.

KidZania may not sell, rent or share your Personal Data with third parties for any reason, except for those stated above, without your prior consent.

RIGHT TO INFORMATION

Pursuant to Article 11 of the PDPL, you can exercise your rights below by applying to Kidzania and filling out the form:

If your personal data is incomplete or incorrectly processed, you can request their correction;
You may request the deletion or destruction of personal data within the framework of the conditions stipulated in Article 7 of the PDPL;
You can request the notification of the transactions made in accordance with the paragraphs 5 and 6 of the third parties to whom the personal data has been transferred;
You can object to the emergence of a result against you by analyzing the processed data exclusively through automated systems, and
In the event that you suffer damage due to the processing of your personal data in violation of the PDPL, you can request the removal of the damage.

AMENDMENTS TO THE PRINCIPLES

From time to time, KidZania may update the Policies as necessary and announces the amended Policies at http://istanbul.kidzania.com/en/privacy-policy. If we make significant amendments that expand our rights to collect and/or use your Personal Data, we will notify you on the website.

GLOBAL DATA PROCESSING AND DATA TRANSFER

There are KZ Locations all over the world. We also acknowledge that the Personal Data we collect may be subject to protections under the laws of your country. Your Personal Data may be transferred or made available to KidZania Companies, Licensees or service providers in other locations around the world. In some of these countries, the equivalent protection of Personal Data may not be required under your local laws. By providing us with your Personal Data, you consent to the transactions, transfers, and disclosures described in these Principles. Any KidZania Company or third party processing data subject to these Principles must comply with these Principles and appropriately protect your Personal Data.

NOTICE TO PARENTS: CHILDREN'S ONLINE PRIVACY

To alert parents about KidZania policies and practices regarding how to handle personal information that may be collected by a child from a KidZania Park, KidZania app, or KidZania online service, KidZania provides the following information:

To allow online interaction between children and KidZania online services, KidZania obtains Park permission from parents and guardians.
KidZania is committed not to collect, use or disclose personal data from children without the prior consent of the parent, the consent of an educational institution on behalf of the parent, or any other legal or principled basis for collecting information (such as the risk of imminent harm to the child). If a parent or guardian refuses to consent to the collection, use or disclosure of information, KidZania will not collect, use or disclose such information.
If the parent or guardian allows the use of a KidZania app, the child can take a picture of themselves and customize it using the graphic elements provided by KidZania. KidZania may ask your child for basic biographical information such as name, age, or month/day of birth, gender, or country of residence of the child, or other non-obviously identifying information.
If the parent or guardian consents to the uploading of the final image and biographical data to the website and/or social media platform operated by KidZania, then KidZania may collect and use the image and provide it to other users of the application and website, third parties that may view the KidZania website, search engines or to other technologies, stakeholders, and service providers that catalog publicly available online content. Third-party websites where users can post content are not controlled by KidZania. KidZania is not responsible for the privacy policies and practices of these third-party websites.
In accordance with the relevant article of the Law No. 6563 on the Regulation of Electronic Commerce, parents or guardians who wish to receive commercial electronic messages regarding our practices and activities from our organization must also give their consent to be informed.
The parent can always withdraw their consent and request that their child's personal information be deleted from KidZania's systems. Upon receipt of such a request, KidZania withdraws the child's content from public view, deletes all copies of the child's content, and denies the child any further access to the website.
The parent may also request a review of the personal information KidZania holds regarding their child and may request that this information be deleted.
